1. Introduction
These Terms & Conditions apply to services provided by Clever IQ, including academic tuition, Islamic learning, enrichment activities, holiday clubs, book clubs, online learning, assessments, consultations and related educational services.
By booking, registering for, purchasing or participating in a Clever IQ service, you agree to these Terms & Conditions.
Where a child or young person participates in a Clever IQ service, the parent or carer making the booking accepts these Terms & Conditions on their behalf.
2. Our Services
Clever IQ provides educational services including:
- one-to-one tuition;
- small-group tuition;
- academic learning programmes;
- Islamic learning;
- enrichment activities;
- holiday clubs;
- book clubs;
- online learning;
- educational assessments;
- consultations;
- workshops; and
- related educational and family-support services.
The precise content, timetable, teacher, venue and format of individual programmes may vary.
We aim to provide services with reasonable care, skill and professionalism.
3. Registration and Enrolment
Parents or carers may be required to complete a registration, booking or assessment process before a child joins a programme.
You are responsible for ensuring that the information you provide is accurate and up to date.
This may include:
- the child’s name and date of birth;
- contact details;
- emergency contact details;
- educational information;
- relevant medical information;
- allergies;
- special educational needs;
- safeguarding information; and
- collection arrangements.
You should inform Clever IQ promptly if any relevant information changes.
4. Assessments and Learning Recommendations
Clever IQ may recommend an assessment before placing a learner into a programme.
Assessment results are intended to help us understand a learner’s current strengths, needs and appropriate learning pathway.
Recommendations are educational judgements and do not guarantee any particular examination result, school placement, grade or academic outcome.
5. Bookings
A booking is not confirmed until Clever IQ has accepted the booking and, where required, received payment.
Places may be limited and are usually allocated on a first-confirmed basis.
We reserve the right to refuse or cancel a booking where:
- a programme is full;
- the learner’s needs cannot reasonably be met;
- required information has not been provided;
- payment remains outstanding;
- safeguarding concerns arise;
- behaviour presents a serious risk to others; or
- there is another reasonable operational reason.
Where we cancel a booking before a service has been provided, appropriate refund arrangements will normally apply.
6. Fees
Fees for each programme will be communicated before booking.
Fees may vary according to:
- type of programme;
- duration;
- group size;
- subject;
- tutor;
- location;
- online or in-person delivery; and
- additional materials or activities.
Clever IQ may change prices from time to time.
Price changes will not normally affect services already fully paid for unless the booking terms specifically state otherwise.
7. Payment
Payment must be made by the date stated on the invoice, booking page or payment request.
Clever IQ may require:
- full payment in advance;
- payment by instalments;
- a deposit; or
- recurring payment for ongoing programmes.
Where payment remains overdue, Clever IQ may suspend or withdraw a learner’s place.
Parents and carers remain responsible for outstanding fees relating to confirmed bookings unless a cancellation right applies.
8. Six-Week and Fixed-Term Programmes
Where a learner enrols on a fixed-term programme, pathway or block of sessions, the booking is normally for the entire stated period.
Fees are therefore usually calculated for the programme as a whole rather than on a pay-as-you-attend basis.
A learner’s non-attendance does not automatically reduce the programme fee.
Any alternative arrangements, credits or catch-up sessions are at Clever IQ’s discretion unless otherwise agreed in writing.
9. Cancellations by Parents or Carers
If you wish to cancel a booking, you should notify Clever IQ as soon as possible.
Cancellation and refund entitlement may depend on:
- how far in advance the cancellation is made;
- whether the programme has started;
- whether a place has been reserved specifically for the learner;
- whether resources or staff have already been committed; and
- the specific booking terms provided at the time of purchase.
Where a cancellation policy is stated on the booking page or invoice, that policy forms part of these Terms & Conditions.
10. Missed Sessions
If a learner misses a scheduled session for reasons unrelated to Clever IQ, the session will normally be treated as delivered.
This may include absence due to:
- illness;
- holidays;
- family commitments;
- transport difficulties;
- forgetting the session; or
- technical difficulties on the learner’s side during online tuition.
Clever IQ is not normally required to provide a refund or replacement session for learner absence.
Where practicable, we may offer reasonable flexibility, but this cannot be guaranteed.
11. Tutor Absence or Cancellation by Clever IQ
If Clever IQ needs to cancel a session, we may:
- provide a replacement tutor;
- reschedule the session;
- provide an alternative session;
- issue a credit; or
- provide an appropriate refund.
We will aim to give reasonable notice where possible.
Occasionally, last-minute changes may be necessary because of illness, emergencies, venue issues or circumstances outside our reasonable control.
12. Tutor Allocation
Clever IQ will make reasonable efforts to match learners with suitable tutors.
We cannot guarantee that a particular tutor will remain assigned to a learner indefinitely.
Tutors may change because of:
- availability;
- staffing changes;
- illness;
- scheduling;
- programme structure;
- safeguarding considerations; or
- educational suitability.
A tutor change does not normally entitle a parent or carer to cancel an ongoing programme without charge.
13. Timetables and Venues
Timetables and locations will be communicated before or during enrolment.
Clever IQ reserves the right to make reasonable changes to:
- lesson times;
- room allocations;
- venues;
- tutors;
- group composition; and
- programme dates.
We will aim to minimise disruption and communicate significant changes promptly.
14. Online Learning
For online learning, families are responsible for ensuring that the learner has reasonable access to:
- a suitable device;
- a stable internet connection;
- any required software;
- a quiet and appropriate learning environment; and
- necessary learning materials.
Clever IQ cannot be responsible for interruptions caused by the learner’s internet connection, device or home environment.
Tutors will maintain appropriate professional boundaries and use approved communication methods where reasonably possible.
15. Behaviour Expectations
Learners are expected to:
- behave respectfully;
- follow reasonable instructions;
- respect tutors, staff and other learners;
- use appropriate language;
- avoid bullying, harassment or intimidation;
- respect equipment and property; and
- behave safely.
We aim to manage behaviour positively and proportionately.
Where behaviour becomes serious, repeated or unsafe, Clever IQ may:
- speak with the learner;
- contact parents or carers;
- issue a warning;
- place conditions on continued attendance;
- suspend attendance; or
- terminate the learner’s place.
Safeguarding concerns will always be dealt with in accordance with our Safeguarding and Child Protection Policy.
16. Parent and Carer Responsibilities
Parents and carers are expected to:
- provide accurate information;
- ensure learners attend punctually;
- communicate relevant changes;
- make payments on time;
- inform us of medical or safeguarding concerns;
- provide appropriate collection arrangements;
- support reasonable behaviour expectations; and
- communicate respectfully with staff.
Clever IQ reserves the right to refuse or terminate services where parent or carer behaviour becomes abusive, threatening, discriminatory or seriously disruptive.
17. Arrival and Collection
Parents and carers remain responsible for ensuring appropriate arrangements for bringing children to and collecting them from Clever IQ activities.
You must inform us where:
- another adult will collect the child;
- the child is permitted to leave independently;
- collection arrangements change; or
- there is any relevant safeguarding restriction.
Clever IQ may refuse to release a child to an unfamiliar person until suitable verification has taken place.
18. Late Collection
Where a child is collected late, staff may need to remain on site beyond the scheduled programme time.
Repeated or significant late collection may result in:
- a warning;
- additional charges where communicated;
- review of the learner’s place; or
- other reasonable action.
Safeguarding procedures will apply where a child is not collected and no responsible adult can be contacted.
19. Safeguarding
The welfare of children is fundamental to Clever IQ.
All staff and tutors are expected to follow Clever IQ’s Safeguarding and Child Protection Policy.
Where a safeguarding concern arises, Clever IQ may share relevant information with appropriate safeguarding agencies where necessary.
Safeguarding obligations may override ordinary confidentiality.
20. Health and Medical Information
Parents and carers must tell Clever IQ about relevant medical conditions, allergies, disabilities or other needs that may affect a child’s participation or safety.
Clever IQ will make reasonable efforts to support learners appropriately but cannot provide medical services beyond the scope of its role.
In an emergency, we may contact emergency services and take reasonable steps to protect the child.
21. Special Educational Needs and Disabilities
Clever IQ aims to support learners with a wide range of needs.
Parents and carers should provide relevant information so that reasonable adjustments can be considered.
We cannot guarantee that every programme will be suitable for every learner.
Where a child’s needs cannot reasonably or safely be met within a particular setting, we may discuss alternative arrangements with the family.
22. Photography and Video
Clever IQ may take photographs or videos during activities where appropriate consent has been obtained.
Images may be used for:
- educational records;
- programme documentation;
- website content;
- social media;
- marketing; or
- promotional material.
Parents and carers may withdraw consent for future public use by contacting Clever IQ.
Safeguarding and privacy considerations will always apply.
23. Recording of Online Sessions
Some online sessions may be recorded for legitimate purposes such as:
- safeguarding;
- training;
- quality assurance; or
- educational review.
Where recording is used, appropriate notice will be given where required.
Recordings remain the property of Clever IQ and must not be copied, shared or distributed without permission.
24. Learning Materials
Learning resources provided by Clever IQ may include:
- worksheets;
- assessments;
- lesson materials;
- presentations;
- videos;
- digital resources; and
- programme materials.
Unless otherwise stated, these materials are provided for the learner’s personal educational use.
They must not be copied, resold, republished or commercially distributed without permission.
25. Intellectual Property
All intellectual property rights in original Clever IQ materials, branding, programme structures and resources remain with Clever IQ or the relevant rights holder.
Participation in a programme does not transfer ownership of these rights.
26. Examination and Academic Outcomes
Clever IQ will make reasonable efforts to provide high-quality education and support.
However, we cannot guarantee:
- examination grades;
- school admissions;
- scholarship outcomes;
- 11+ results;
- university offers;
- Oxbridge admission;
- particular academic progress; or
- any other specific outcome.
Educational progress depends on many factors, including attendance, effort, prior attainment, home support and individual circumstances.
27. External Examinations and Applications
Where Clever IQ supports learners with external examinations, applications or admissions processes, responsibility for submitting official forms, checking deadlines and complying with third-party requirements remains with the learner and parent or carer unless Clever IQ has expressly agreed otherwise in writing.
Clever IQ is not responsible for decisions made by:
- schools;
- examination boards;
- universities;
- admissions authorities; or
- other third parties.
28. Personal Belongings
Learners remain responsible for their personal belongings.
Clever IQ cannot accept responsibility for lost, stolen or damaged personal items except where loss or damage results directly from our negligence.
Valuable items should not be brought to sessions unless necessary.
29. Damage to Property
Parents or carers may be asked to contribute to the reasonable cost of repairing or replacing property that is deliberately or seriously damaged by a learner.
Normal wear and tear will not be charged.
30. Third-Party Venues
Some Clever IQ activities may take place in schools, community buildings, outdoor venues or other third-party premises.
Users must follow reasonable rules imposed by those venues.
Clever IQ cannot be responsible for matters outside its reasonable control relating to third-party premises, although we will take reasonable steps to select appropriate environments.
31. Events and External Providers
Some activities may involve external speakers, teachers, venues, transport providers or other organisations.
Where appropriate, Clever IQ will take reasonable safeguarding and due-diligence measures.
However, third-party providers may operate under their own terms and policies.
32. Force Majeure and Events Outside Our Control
Clever IQ will not normally be liable for failure or delay caused by events outside our reasonable control.
These may include:
- severe weather;
- transport disruption;
- public-health emergencies;
- government restrictions;
- power failures;
- internet outages;
- venue closures;
- civil emergencies; or
- other exceptional circumstances.
Where possible, we will seek to offer reasonable alternative arrangements.
33. Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
Subject to applicable law, Clever IQ will not be responsible for indirect or unforeseeable losses arising from participation in our services.
We will exercise reasonable care and skill in providing educational services.
34. Refunds
Any refund will depend on:
- the circumstances of cancellation;
- whether the service has begun;
- whether sessions have already been delivered;
- the terms stated when booking; and
- applicable consumer rights.
Where a refund is approved, it will normally be returned using the original payment method where reasonably possible.
35. Cooling-Off Rights
Where a parent or carer purchases a service online, by telephone or away from Clever IQ’s premises, statutory consumer cancellation rights may apply in some circumstances.
Where you ask us to begin providing a service during a statutory cancellation period, you may be required to pay for services already provided if you later cancel.
Nothing in these Terms & Conditions removes any rights that cannot legally be excluded.
36. Complaints
We aim to resolve concerns fairly and promptly.

Complaints will be handled in accordance with Clever IQ’s Complaints Policy.
Safeguarding concerns should be raised under the Safeguarding and Child Protection Policy rather than treated solely as ordinary complaints.
37. Privacy
Personal information will be handled in accordance with Clever IQ’s Privacy Policy and applicable data protection law.
By using our services, you acknowledge that personal information may be processed where reasonably necessary to provide education, administer services, safeguard learners and meet legal obligations.
38. Changes to Programmes
Clever IQ may update programme content, teaching methods, resources or delivery arrangements where this is reasonably necessary to:
- improve educational quality;
- respond to learner needs;
- comply with law or guidance;
- address staffing changes; or
- respond to operational circumstances.
Changes will not materially reduce the overall nature of a paid programme without reasonable justification.
39. Suspension or Termination of Services
Clever IQ may suspend or terminate a learner’s place where there is:
- serious or persistent misconduct;
- non-payment;
- safeguarding risk;
- abusive behaviour by a learner, parent or carer;
- repeated breach of these Terms & Conditions;
- inability to meet the learner’s needs safely; or
- another serious operational reason.
Where appropriate, we will seek to discuss concerns before termination.
Immediate suspension may be necessary where safety is at risk.
40. Changes to These Terms
Clever IQ may update these Terms & Conditions from time to time.
Where changes materially affect an ongoing paid service, we will seek to provide reasonable notice.
The latest version will be published on our website.
41. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that apply.
